Signing with consumers in the United States (ESIGN disclosure)
When the US ESIGN Act's consumer disclosure is needed, what your signers see, and what happens if they ask for paper.
The US federal ESIGN Act lets businesses deliver records to consumers electronically only after the consumer has been told their rights and has agreed in a way that shows they can open the documents. SignSpry can do this for you.
When it is on
The disclosure is on by default for envelopes from organisations whose country is the United States, and you can switch it on or off for any envelope under Options → Show the US ESIGN consumer disclosure on the prepare screen. It applies once SignSpry has published the disclosure text.
What your signers see
Before the document, each signer reads the disclosure — their right to paper, what the consent covers (this envelope only), how to withdraw, how to update their details, and what they need to open the documents. They open a short test PDF, tick that they agree, and continue to the document.
What each signer agreed to, which version of the text and when are recorded in the envelope's audit trail and printed on the certificate of completion. Admins can download every consent as a spreadsheet from Privacy & data → Signer consent records.
If a signer asks for paper
They can choose Withdraw consent and ask for paper instead. The envelope closes as declined, and you get an email with their note. You must then give them a paper copy. What a paper copy costs (free unless you say otherwise) is set under Admin → Signing & eSign.
